Microsoft Donation Eligibility

We recently purchased 40 licenses of office 2007 from Techsoup.  I assumed we qualified because TechSoup said we did and we were able to get the licenses.  Is it possible that we do not qualify based on separate Microsoft terms?  For example, we are a non-profit in the health care industry, someone brought to my attention that they thought health care industry folks were not eligible for Microsoft products as a donation.  Could this be possible and I bought these for nothing?  I didn't see anything in the Microsoft agreement stating this but maybe I was looking in the wrong place.

As a very general rule, healthcare organizations do not qualify for Microsoft donations. I am sure there are exceptions.

What I cannot gather based on your post is what, exactly, is the issue you are having? Apparently you received the licenses. Are you having difficulty applying the licenses?

There really is no issue but I was told by a colleague that just because I qualified and received the donations from Techsoup that I still may be non compliant based on Microsoft's terms.  Maybe this person is mis-informed? I have no issue applying the licenses.

Is it safe to say that since I was approved and qualified on the techsoup side that I will have no issues with Microsoft down the road in regards to this particular donation?

according to the Microsoft restricted organizations [ listed here ]:

  • Healthcare organizations and networks - Healthcare organizations and networks including hospitals, specialty networks, ambulatory healthcare services, home healthcare, and assisted living healthcare organizations are not eligible. Please visit the Microsoft Healthcare Web site.
    Exceptions: The following types of healthcare organizations are eligible to request Microsoft software donations.
    • Community health clinics - 501(c)(3) community health clinics that are designated as Community Health Center Programs by the U.S. Department of Health are eligible to receive donations.
    • Behavioral healthcare nonprofits - organizations that provide mental health, chemical dependency, mental retardation/developmental disabilities services, and other psychosocial services to the community.
    • Women's health centers
    • Blood banks
  • Healthcare research organizations and research laboratories - includes organizations pursuing systematic investigation, including research development, testing and evaluation, designed to develop or contribute to general knowledge. Please visit the Microsoft Healthcare Web site

So if you fall under one of the exceptions, or do not necessarily fall under the explicit restrictions, then you're fine.  As for difficultied down the road with Microsoft, mmmm...  nah, they allow TechSoup to take an admin fee to kind of loosely check to make sure applying organizations fall within their guidelines.

In my opinion, if you were truthful in registering your organization with tech soup in the categorization questions, then you would be falling under one of the exceptions.  Like Chris said it is Tech soup that is applying the donor restrictions against the donation request.
