Apologies for re-opening a thread. Our group has hit a problem with getting a more recent determination letter. We're a local chapter under a national group with "GROUP" eligibility listed as current on the IRS lookup site, but the national determination letter is 15 years old. I've been told by our central treasurer that the IRS does not reissue letters that would have a new date. The IRS site provides an Affirmation letter option, would that be a workable substitute?

Thank you for your post, and I'm sorry for the confusion this caused. Since you're connected to a parent organization, what we need in this case is called a Group Exemption Letter. This will come from your parent organization, and it'll essentially explain that you're a subordinate of the parent organization. I've just emailed you a template for what this letter should look like.

Yes, an Affirmation Letter would be sufficient in this case.
Could I get a copy of the group exemption letter template? I'm trying to get our Boy Scout troop cleared, and have been asked for a group exemption letter or 501(c)(3) determination letter. I presume a group exemption letter from the church that charters us (and whose ein I used in the application) would suffice?
Thanks for your question. Boy Scout troops are not eligible to have their own accounts using a church or school’s EIN, even if you're chartered through them. If you're not under a local or regional chapter of the Boy Scouts, you can use the National Council's EIN. If you don't have that, I encourage you to get in contact with the National Council; they should be able to assist you with this matter. They will be able to send you a copy of the Group Exemption Letter, too.
Actually, BSA units can use the ein of the chartering organization if the organization gives them permission. Since the unit is actually "owned" by the chartering organization, any tax exemption is based upon the status of the chartering organization. Furthermore, individual BSA units (packs, troops, etc) cannot claim exemption under the BSA's group exemption because they are "owned" by the chartering organization. So back to my original request, I should just need a letter from the church, whose ein we are operating under with permission, to confirm we are their scout troop and, therefore, tax exempt too. Right?
Thanks for your reply! Sorry for the confusion: I wasn't referring to BSA's policy; I was referring to TechSoup's policy.
TechSoup's policy is that Boy Scout Troops must be under the EIN of the National Council, not the charter organization(usually a school or church). To qualify, you'll need to supply TechSoup with a 501(c)(3) determination letter or GEL from BSA.

I have been going back and forth with customer service. If you read the IRS definition of what needs to be included in a GEL the BSA Charter Agreement meets the IRS requirements it, however, is not called a GEL because it is organization specific.
I, however, am having problems getting my Pack certified. Please help.
I'm having similar issues getting our Troop certified. Is there anyone out there that has been successful in getting their Troop or Pack verified by TechSoup?
